By accessing this website you acknowledge that you have read and accept these Terms and our Privacy Policy, which is incorporated into these Terms by reference.

3. PUBLIC AND RESTRICTED AREAS OF THE WEBSITE

Parts of this website are open to the public. Other parts — such as league portals, account pages, or customer-only areas — are restricted and require registration. You may not access a restricted area unless you have been granted access, and you may not attempt to bypass any login, access control, or security feature of the website.

We reserve the right to deny access to the website, or any part of it, to any person at our discretion.

4. USING THIS WEBSITE

We grant you permission to use the website and to display and print materials from it, provided that:

your use is for your personal, non-commercial purposes;
you do not copy, republish, or distribute any part of the website or its content in any medium without our prior written permission;
you do not alter or modify any part of the website beyond what is reasonably necessary to use it as intended; and

Some features may require you to create an account. If you create one, you agree to provide accurate and complete information, to keep your password secure, and not to use anyone else's account without their permission. The website and its contents are owned or licensed by Holiday Lanes and are protected by copyright, trademark, and other laws. Except for the limited permission described in Section 4, you receive no rights in the website's content.

6. YOUR SUBMISSIONS

If you send us a message, review, photo, comment, or other content through this website ("Submission"), you keep ownership of it. You grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that Submission in connection with operating and promoting Holiday Lanes, unless you tell us otherwise in writing.

You agree not to submit anything unlawful, defamatory, infringing, or that you do not have the right to share.

Personal information you send us — including your name, email address, and phone number — is handled according to our Privacy Policy, not this section. We do not sell your personal information, and we do not share mobile phone numbers or SMS consent with third parties or affiliates for marketing or promotional purposes.

7. SMS / TEXT MESSAGE PROGRAM

This section governs the Holiday Lanes text messaging program. By opting in, you agree to the terms in this section.

7.1 Program description

Holiday Lanes offers a text messaging program that sends SMS and MMS messages to customers who have consented to receive them. Depending on how you signed up and what you asked for, messages may include:

Promotional messages — specials, coupons, open bowling deals, league night promotions, tournaments, events, and party offers
Transactional and account messages — reservation and party booking confirmations, lane reservation reminders, league schedule and standings updates, receipts, and changes to a booking
Customer care messages — replies to questions you send us and other two-way conversation

7.2 How you opt in

You may join the Holiday Lanes text messaging program in any of the following ways:

Online. By checking the SMS consent box on a form on our website — for example a contact form, party or event inquiry, league signup, or email/text list signup — and submitting the form.
In person or on paper. By providing your mobile number and checking the SMS consent box on a signup sheet, league registration form, party or event contract, counter form, or in-center kiosk at Holiday Lanes.
By text. By texting a keyword such as JOIN to (318) 746-7331.

In every case, consent is given by you and is not transferred, sold, purchased, or shared. We do not add numbers to the program that were obtained from a third party, a purchased list, or any source other than the person who owns the number.

Consent is not a condition of purchase. You do not have to agree to receive text messages in order to bowl, book a party, join a league, or buy anything from Holiday Lanes.

7.3 Message frequency

Message frequency varies. Promotional messages are generally sent no more than a few times per month. Transactional messages are sent as needed, based on your reservations, bookings, or league activity.

7.4 Message and data rates

Message and data rates may apply. Holiday Lanes does not charge for text messages, but your mobile carrier's standard messaging and data rates will apply to every message sent and received. Please contact your carrier if you have questions about your plan.

7.5 How to opt out

You can cancel at any time. Just text STOP to (318) 746-7331. After you send the message "STOP" to us, we will send you a message confirming that you have been unsubscribed, and you will no longer receive text messages from us. If you want to rejoin later, sign up again as described in Section 7.2 and we will resume sending messages to you.

We honor the keywords STOP, END, CANCEL, UNSUBSCRIBE, and QUIT.

7.6 How to get help

For help, text HELP to (318) 746-7331 and we will reply with instructions on how to use our service and how to unsubscribe. You may also reach us at (318) 746-7331 or info@bowlholidaylanes.com.

7.7 Carriers are not liable

Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your mobile carrier and is outside our control. We do not guarantee that every message will be delivered, or delivered on time.

7.8 Eligibility

You must be at least 18 years old, and must be the account holder of — or have the account holder's permission to use — the mobile phone number you provide, in order to opt in to the text messaging program.

7.9 If your number changes

If you change or give up your mobile phone number, please notify us at info@bowlholidaylanes.com or (318) 746-7331 so we do not send messages to someone who did not sign up.

7.10 Privacy

Information you provide in connection with the text messaging program is handled according to our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with subcontractors that provide support services to us, such as our messaging platform and customer service providers, solely so they can help us operate the program.

8. DISCLAIMERS

YOU AGREE THAT YOUR USE OF THIS WEBSITE SHALL BE AT YOUR SOLE RISK. THIS WEBSITE AND ALL MATERIALS, INFORMATION, AND SERVICES AVAILABLE THROUGH IT ARE PROVIDED TO YOU "AS IS," "WITH ALL FAULTS," AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, HOLIDAY LANES, ITS AFFILIATES, AGENTS, OFFICERS, DIRECTORS, AND EMPLOYEES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE OF IT. HOLIDAY LANES MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SITE'S CONTENT OR THE CONTENT OF ANY SITES LINKED TO IT, AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR:

9. LIMITATION OF LIABILITY

IN NO EVENT SHALL HOLIDAY LANES, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY OF THE MATTERS LISTED IN SECTION 8, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

YOU SPECIFICALLY ACKNOWLEDGE THAT HOLIDAY LANES SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR FOR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY, AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

10. INDEMNITY

You agree to defend, indemnify, and hold harmless Holiday Lanes, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including reasonable attorneys' fees) arising from: (i) your use of and access to the website; (ii) your violation of any term of these Terms or breach of any representation or warranty herein; (iii) your violation of any third-party right, including any copyright, property, or privacy right; or (iv) any claim that one of your Submissions caused damage to a third party. This obligation survives these Terms and your use of the website.

11. DISPUTES

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. This section provides that most disputes between you and Holiday Lanes will be resolved by binding arbitration instead of in court before a judge or jury, and may limit your rights to discovery and appeal. It also provides that you will not be able to bring a class action or other representative action, in court or in arbitration.

Either you or Holiday Lanes may elect mandatory, binding arbitration of any claim, dispute, or controversy arising from these Terms or your use of the website (a "Claim"), with the following exceptions: either party may bring an individual action in small claims court, and either party may seek injunctive relief in court to protect intellectual property rights.

Neither you nor Holiday Lanes consents to arbitration on a class or representative basis, and the arbitrator has no authority to proceed on that basis. No arbitration will be consolidated with another arbitration without the consent of all parties.

Arbitration shall be conducted under the rules of the American Arbitration Association in effect on the date the dispute is submitted, including its Consumer Arbitration Rules where applicable. Information about the AAA, its rules, and its forms is available at adr.org. The arbitration will take place in Bossier Parish, Louisiana, or by telephone or video at your election, before a single arbitrator. The arbitrator will apply applicable substantive law, including the applicable statute of limitations, and will honor claims of privilege recognized at law.

30-day right to opt out of arbitration. You may reject this arbitration provision by sending written notice within 30 days of first accepting these Terms to: Holiday Lanes, Attn: Legal, 3316 Old Minden Road, Bossier City, LA 71112. Your notice must include your name, address, and a clear statement that you do not wish to resolve disputes through arbitration. Opting out will not affect any other part of these Terms.

Each party will bear its own attorneys' fees and costs except to the extent that applicable law or the arbitrator's award provides otherwise.

12. JURISDICTION AND VENUE

For any matter not subject to arbitration, or brought before or after arbitration, you agree that the sole and exclusive jurisdiction and venue will be the state or federal courts located in or nearest to Bossier Parish, Louisiana.

13. APPLICABLE LAW

These Terms are governed by the laws of the State of Louisiana, without regard to its conflict of law provisions.

14. SEVERABILITY

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
